RMIT Training Pty Ltd (ACN 006 067 349) Level 9, 501 Swanston Street, Melbourne, Victoria 3000, trading as Informit (the Publisher) grants you, the User, access to the text of the selected and purchased copyright works included in the INFORMIT PAY-PER-VIEW SERVICE (the Service) on the following terms (the User Terms).

1. Definitions

Coursepack means a collection or compilation of copyright works assembled by or on behalf of the Licensee for use by students for the purposes of instruction, and includes a collection or compilation of works in digital form;

User means an individual who a Licensee has permitted to have occasional access to the Service via the Secure Network by means of a password and /or IP addressing.

2. Permitted Uses

On payment of the fee and subject to the restrictions in clause 3 below, a User may, for the purposes of the User's individual and private research or study:

  1. search, retrieve and view any article in the Service,
  2. make one digital reproduction of an article in the Service, and
  3. print one paper reproduction of an article in the Service.

3. Restrictions

In consideration of the grant of this licence, the user agrees and acknowledges that:

  1. where you are a student or staff member of an educational institution or government department, you will not make further reproductions or communications, or make copyright material you have obtained under the Service available for viewing, reproduction or communication, other than in reliance on Part VB or Part VII Division 2 or Part III Division 3 of the Copyright Act 1968;
  2. you will not remove any copyright notices or other rights management information, nor use any device or service to circumvent any technological protection measure incorporated in the Service, other than in reliance on Part V of the Copyright Act 1968;
  3. except in reliance on Part VB or Part VII Division 2 or Part III Division 3 of the Copyright Act 1968, you will not use any copyright material you have obtained under the Service as a component of or basis for a book, directory, bibliography, database, Coursepack or any other compilation;
  4. except as authorised by these User Terms, you are expressly prohibited from electronically reproducing and storing, emailing or otherwise communicating any copyright works or digital reproduction of copyright works which you have obtained under the Service; and
  5. you will not exercise any of the rights comprised in copyright in any works you have obtained under the Service except as permitted by these User Terms or with the prior written permission of the copyright owner or its exclusive licensee.

4. Rights Ownership

Copyright in the Informit interface and the bibliographic data in the Service remains the property of the Publisher.

Copyright in the full content data of works provided through the Service remains the property of the original publisher or other rightsholder and access is provided as part of the Service under licence from Copyright Agency Limited (CAL) Australia or the original publisher or other rightsholder.

Copyright in the Adobe Acrobat Reader remains the property of Adobe Systems Incorporated.

Copyright in the converted data and conversion programs remains vested in the Publisher.

Copyright in the TeraText information retrieval software remains the property of InQuirion Pty Ltd.

5. Use of Information

The Publisher will collect information on the use of the Service and may transfer that information to CAL or other rightsholders. This information will be in the aggregate only and will not contain information traceable to individual users or organisations. CAL will use that information for the purpose of allocating monies to CAL members for the use of their copyright material. CAL's Privacy Policy may be inspected at

6. No Implied Warranty

The Publisher does not warrant that the Service will meet your requirements, that its operation will be uninterrupted or error free, that the copyright material accessible via the Service will not vary or that the source data or methodology is accurate. In the event of an interruption to the service, the Publisher will take reasonable measures to restore access to the Service as soon as possible.

7. Liability

To the maximum extent that the law allows neither the Publisher nor any of its officers, employees or agents shall be liable for any claim:

  1. for breach of warranty or representation, express or implied, arising out of negligence; or
  2. arising out of the content of any copyright work included in the Service;
  3. and in no event shall the Publisher be liable for any damages, including consequential loss or damages arising directly or indirectly out of the use of the Service.

8. Governing Law, Severance, Waiver

This Agreement shall be construed in accordance with the laws of the State of Victoria and within the jurisdiction of the Victorian courts. Should any part of this Agreement be or become invalid, that part at the option of the Publisher shall be severed from this Agreement without affecting the validity of the remaining provisions. No delay or indulgence by the Publisher in enforcing this contract shall prejudice its rights.
